1. Scope & Acceptance
These Terms of Service ("Terms") govern your access to and use of the TLDC System (the "System"), a platform operated by the Training and Livelihood Development Center of the Local Government Unit of Bago City, Negros Occidental, Philippines ("TLDC", "we", "us"). The System provides online information on training programs, slot openings, application submission, schedule tracking, and related services.
By creating an account, signing in with Google, or submitting an application, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not create an account or submit an application. Account creation requires you to check "I agree to the Terms of Service and Privacy Policy" — your acceptance is recorded as users.terms_accepted_at.
2. Eligibility
The System is intended for residents who meet program-specific eligibility criteria, including age, residency in Bago City (or as otherwise stated per program), educational attainment, and any course prerequisites published on the relevant slot opening. You must provide truthful information. Browsing course and announcement listings does not require an account; applying does.
Minors (under 18) may use the System with the knowledge and consent of a parent or guardian. Where we collect a parent or guardian name and contact (e.g., on the TESDA learner profile), we treat the parent/guardian as having authorized the minor's participation for that application.
3. Accounts & Security
Registration. You may register with email and password (verified by one-time code) or with Google OAuth. Google accounts are considered pre-verified by Google. Staff and administrator accounts are created by existing administrators and are not self-registered.
Credentials. You are responsible for safeguarding your password and for all activity under your account. Use a strong, unique password. Do not share it. Notify us promptly at info@tldc-bago.gov.ph if you suspect compromise.
Google linking. If an existing email account links a Google identity with the same email address, the System stores the Google identifier to enable future Google sign-in. Linking does not change your role.
Security measures. The System applies throttling, CAPTCHA (Cloudflare Turnstile), session controls, and audit logging, and may temporarily lock an account after repeated failed attempts. Deactivated accounts lose access immediately even with a live session.
4. Applications & Training Slots
Applications. Submitting an application requires you to complete your applicant profile (including identity verification where applicable), select a course and slot opening when available, and affirm the per-submission privacy consent (application_form_data.privacy_consent). Each submission is evaluated by TLDC staff. Submission does not guarantee a slot, scholarship, or certificate.
Slot openings and offers. Training slots have offer windows with deadlines. If you are selected, you will be notified via email and/or your applicant dashboard and must respond within the stated window. Unanswered offers may expire and the slot may be offered to the next applicant in queue.
Batches and outcomes. Accepted applicants may be assigned to training batches. Completion, assessment, and certification (including TESDA National Certificates where applicable) are subject to program requirements, attendance, and assessment results.
5. Your Responsibilities
You agree to:
- Provide accurate, current, and complete information and keep your contact details up to date.
- Submit only authentic government IDs and supporting documents. Uploaded ID images may be processed by an authorized OCR service to assist verification — you consent to that processing by uploading.
- Not impersonate any person, create multiple accounts to evade limits, probe or bypass access controls, or use automated scripts to scrape or spam the System.
- Comply with instructions from TLDC staff regarding schedule, venue, and training conduct.
Profile fields that are locked after verification (e.g., name, date of birth, National ID) may only be corrected through a formal Request Profile Update with supporting ID, subject to staff/admin review. Abuse of the update process may result in restriction.
6. Intellectual Property
The System, its design, code, course descriptions, announcements, and training materials are owned by TLDC LGU Bago City or its licensors. You are granted a limited, non-exclusive, non-transferable license to use the System for personal, non-commercial training-application purposes. You may not copy, modify, distribute, or reverse-engineer the System except as permitted by law.
Content you submit (application data, messages to staff) remains yours, but you grant TLDC a license to store, process, and use it for training administration, compliance, and audit as described in the Privacy Policy.
7. Disclaimers
Program information, schedules, and slot availability are provided in good faith and may change without notice due to operational, TESDA, or LGU requirements. We do not guarantee that any course, schedule, or venue will remain available, or that your application will be approved. Training and certification outcomes depend on your participation and on external assessment bodies where applicable.
The System is provided "as is" and "as available" without warranties of any kind, to the extent permitted by law.
8. Limitation of Liability
To the extent permitted by law, TLDC LGU Bago City and its officers, staff, and service providers are not liable for indirect, incidental, consequential, or punitive damages arising from your use of the System. Where liability cannot be excluded, it is limited to the amount you paid to use the System (which is provided free of charge for qualified applicants).
Nothing in these Terms excludes liability that cannot be excluded under Philippine law.
9. Suspension & Termination
We may suspend or terminate your account or restrict access where we reasonably believe you have violated these Terms, submitted fraudulent documents, abused rate limits, or where required by law or TESDA directive. Deactivated accounts lose access immediately even with a live session. You may request deactivation of your account by contacting the TLDC office; we will retain certain records as required by law and audit policy.
10. Changes to These Terms
We may update these Terms to reflect operational, legal, or regulatory changes. When we make material changes, we will update the "Last updated" date above and, where required, ask you to re-accept on next sign-in before continuing to use the System. Your continued use after an update constitutes acceptance of the revised Terms. If a re-acceptance gate is deployed (future terms_version), you will be directed to re-accept before reaching your dashboard.
11. Governing Law
These Terms are governed by the laws of the Republic of the Philippines. Venue for any dispute arising from the System is the proper courts of Bago City, Negros Occidental, to the extent permitted by law, without prejudice to alternative dispute-resolution mechanisms offered by the LGU.
